1. Acceptance of Terms

By downloading, installing, or using Tubely ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. These terms constitute a legal agreement between you and Its Not A Corn LLC ("we", "our", or "us").

2. Description of Service

Tubely is a parental control application that allows parents and guardians to curate a safe video library from YouTube for their family. The App does not host or stream video content directly — all video playback is handled by YouTube's embedded player on your device.

3. Account Registration

You must create an account to use the App. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials and PIN
Accept responsibility for all activity under your account
Notify us immediately of any unauthorized use of your account

You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

4. Subscriptions and Payments

Tubely offers the following subscription plans:

Free: 1 profile, 10 videos
Basic ($4.99/month): Unlimited profiles and videos, watch history
Family ($39.99/year): Unlimited profiles and videos, analytics, channel auto-sync, priority support

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.

Free Trial: If offered, the free trial period lasts 7 days. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

Managing Subscriptions:You can manage or cancel your subscription through your device's Settings > Apple ID > Subscriptions (iOS) or Google Play Store > Subscriptions (Android).

Refunds: All payments are processed by the Apple App Store or Google Play Store. Refund requests must be directed to the respective store.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or disassemble the App
Use the App to distribute harmful, offensive, or inappropriate content
Interfere with or disrupt the integrity or performance of the App

6. Content and YouTube

Tubely enables parents to search and add YouTube videos to their family library. We do not control, endorse, or guarantee the accuracy or appropriateness of any YouTube content. Video availability is subject to YouTube's own terms and policies. Your use of YouTube content through the App is subject to YouTube's Terms of Service and Google's Privacy Policy.

7. Parental Responsibility

Tubely is a tool to assist parents in managing video content. Parents and guardians remain solely responsible for supervising their children's use of the App and any devices on which it is installed. We do not guarantee that all content added to your library is appropriate for all ages.

8. Account Deletion

You may delete your account at any time through the App (Settings > Delete Account). Upon deletion, all your data — including child profiles, video libraries, watch history, and account information — will be permanently removed from our servers. This action cannot be undone.

9. Intellectual Property

The Tubely name, logo, and App design are the property of Its Not A Corn LLC. You may not use our trademarks without prior written consent. The App is licensed, not sold, to you for personal, non-commercial use.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for the availability or content of third-party services, including YouTube.

11. Limitation of Liability

To the maximum extent permitted by law, Its Not A Corn LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
